First Defective Hip Implant Lawsuits Settled by DePuy Orthopaedics
The first DePuy hip implant lawsuits with a scheduled jury trial have been settled by the medical device maker, for about $200,000 each, in confidential deals. The three cases were set to be tried together in state court in Las Vegas, Nevada, beginning on December 3, 2012. DEPUY HIP IMPLANT RECALL
Although a DePuy spokesperson would not specify if the company intends to settle additional defective hip implant cases, a second state case is scheduled for trial in Maryland in January 2013. Other cases have been filed in state courts in Florida, California, Utah and Wisconsin. DePuy Orthopaedics is a division of Johnson & Johnson, a healthcare giant that is now facing more than 8,000 DePuy ASR side effect claims in state and federal courts. In August 2010, DePuy recalled 93,000 hip implant devices including the ASR XL Acetabular System and the ASR Hip Resurfacing System. The metal-on-metal hip implants reportedly rubbed against one another during normal use, causing the implant to fail within a few years instead of lasting the average 15. In addition, the rubbing caused metal shavings to be shed in patients’ bodies, resulting in a side effect called metallosis.
