While assault can occur when one person simply threatens another, the offender may be charged with assault and battery if physical contact has been made. A crime is characterized as ‘aggravated assault and battery’ when the attack results in great bodily injury to the victim, or if the crime occurs against an elderly, disabled, or incapacitated person.
