Three medical device manufacturers, including Johnson & Johnson, are facing a wrongful death lawsuit that alleges a man’s insulin overdose was caused by problems with a OneTouch Ultra Blood Glucose meter and test strips. DANGERS OF DEFECTIVE MEDICAL DEVICES
According to allegations raised in the wrongful death lawsuit, Leslie Cousin’s fatal insulin overdose was caused by the defective blood glucose meter and test strips, which the family says provided inaccurate blood sugar readings. The meter apparently reported that Cousin’s blood sugar level was very high, leading him to take too much insulin and slip into a coma, before dying a year later. The wrongful death suit accuses the defendants of designing and manufacturing a defective product and failing to warn consumers about the risks associated with the faulty medical device. Cousin’s family is seeking damages for physical injury, medical bills, loss of income and earning capacity, disability, pain and suffering, loss of enjoyment of life and wrongful death.
BLOOD GLUCOSE METER TEST STRIPS RECALLED
The complaint notes that the test strips, manufactured by Lifescan Inc., sold by Diabetes Management and Supplies, and possibly used by Cousin, were recalled due to problems with inaccurate blood sugar readings. The recall was issued in March 2010 and affected approximately 14,000 packages of OneTouch SureStep blood glucose meter test strips. The strips were recalled after it was discovered that they could provide incorrect readings of blood glucose levels in patients. Although it is unclear whether these particular test strips were used by Cousin before his death, both Diabetes Management and Supplies and Lifescane Inc. are listed as defendants in the lawsuit, along with the maker of the OneTouch Ultra Blood Glucose Meter – Johnson & Johnson.
