About Assault and Battery Charges

Assault and battery is a charge that indicates one person threatened another with physical harm and followed through with physical contact and, in some cases, injury. Broken down, an “assault” charge refers to the portion of the law where one person is threatening another with harm, whereas “battery” is when the person actually follows through with the threat. In itself, assault could result in the following:

  • A jail sentence of up to 30 days;
  • A fine of up to $500, or both’
  • On the other hand, a charge of assault and battery could result in the following punishments:
    • A jail sentence of up to 90 days
    • And a fine of up to $1,000

Beyond the straightforward assault and battery charge is aggravated assault and battery, which indicates serious bodily injury occurred as a result of physical contact. This is a felony charge and could result in the following punishments:

  • A state prison sentence of up to 5 years; or
  • A jail sentence of up to 1 year;
  • A fine of up to $500; or both a fine and imprisonment

Domestic Violence and Assault and Battery
